realme Link ("realme Link" or "App") is developed and operated by Realme Mobile Telecommunications (Shenzhen) Co., Ltd. and its affiliates (collectively, "we", "us", or "our", settled in Shenzhen Qianhai Commerce Secretariat Co. Ltd. with the registered office at Room 201, Building A, No. 1 Qianwan First Road, Qianhai, Shenzhen-Hongkong Cooperation Zone, Shenzhen) to provide you with services to control and manage your smart devices. This realme Link Privacy Notice (this "Privacy Notice") explains what personal information about you we collect, store, process, transmit, provide, disclose, or delete (collectively, "process") during your use of the App, how and why we collect such information, your rights to your personal information, and the security measures we use to protect your personal information.

 

Before using the App, please carefully read and fully understand all the content of this Privacy Notice and related user service agreements and make the choices that you deem appropriate. If you do not agree to the terms of this Privacy Notice, you can exit the App by tapping "Disagree" and we will not be able to provide you with services related to the App. By tapping "Agree", you acknowledge that you have carefully read this Agreement and fully understood the processing of your personal information as described below. Once you use or continue to use the App, you agree to our processing of your personal information in accordance with this Privacy Notice.

If you are a child under the age of 14 or a similar minimum age defined in the relevant jurisdiction, according to the law you must read this Privacy Notice in the company of your guardian and make sure that you fully understand its content. You can use the App only after giving explicit consent to this Privacy Notice.

We operate and provide services globally. Some of the smart devices or services we provide, however, may vary depending on where you live. Before using our smart devices or services, you should carefully read this Privacy Notice and relevant privacy notices or supplementary statements to become fully informed.

In addition to this Privacy Notice, some other privacy notices may also apply depending on the products or services you use. In each case, we will adequately inform you of the applicable privacy notices.

The general terms in Part A apply to you, regardless of your location. Part B only applies to users located in the European Union, Liechtenstein, Norway, the United Kingdom, or Switzerland ("Europe"). Part C only applies to users located in California, the US.

1. How We Collect and Use Your Personal Information

1.1 Information we collect

We collect your personal information based on the principles of lawfulness, fairness, and necessity. To provide you with our services, ensure the normal functioning and security of our products and services, and improve and optimize our products and services, we will collect the information provided by you, authorized by you, or generated when you sign in to or use our products and services.

The information we collect depends on the products and services you use, the environment in which you interact with us, and the choices you make, including your privacy settings and the products and features you use. Please note that if you provide other people's personal information to us, you must ensure that you have obtained their authorization (and, in the event of a special scenario, separately obtain their consent).

 

In addition to the basic features and services, including online browsing and version upgrading, the App provides additional features and services, including account creation and sign-in, profile setting, device pairing, device management, device information widgets, device sharing, location services, workout and health monitoring, workout ranking, realme Store, help & feedback, reminders and notifications, push notifications, body fat scale pairing, Ask AI, AI watch faces, user experience optimization, and third-party device pairing. Please note that the aforementioned features and services may vary according to your region and the smart devices you use.

When we collect information, you are not obliged to provide your personal information. However, if you do not provide the information necessary to provide the basic features, we may not be able to provide you with the related products or services, nor can we respond to or deal with the problems you may encounter. The additional features are turned off by default. When you attempt to use any of such features or related services, we will display a prompt asking for your consent to turn them on. By turning them on, you agree to our processing of your personal information in relation to such features. If you do not provide such information, the additional features you request may not be available to you. This, however, does not affect your use of the basic features.

Please note that we usually consider the region that you select during your initial sign-in (or that you select subsequently through "Settings") as the actual place where the products and services are used and the jurisdiction whose laws and regulations we comply with, including those relating to data protection.

1.1.1 Categories of information we may collect
The following describes the information we may collect in connection with features and services.

1.1.1.1 Basic features and services

(1) Online browsing

We do not collect your personal information while you are browsing online through the App.

(2) Version upgrading

To let you upgrade the App, we need to collect the App ID, App version, your area code, and your phone's language settings so that we can use such information to detect and download the latest available version of the App. To let you upgrade the firmware of your smart device paired with the App, we need to collect the smart device's ID and version information, the App version, the smart device's MAC address, your area code, and your phone's language settings so that we can use such information to detect and download the latest available firmware version for the smart device. If you do not provide the aforementioned information, you will not be able to upgrade the App or the firmware of the smart device.

1.1.1.2 Additional features and services

(1) Account creation and sign-in: You can choose to create a HeyTap Account or, if you already have one, sign in to your HeyTap Account to use the App. HeyTap Accounts are provided by HEYTAP PTE. LTD. ("HeyTap"). During the account creation or sign-in process, HeyTap will collect your phone number or email address, your password, and the SMS verification message you receive to create an account for you and/or assist you in signing in to your account in order for you to use related services. After HeyTap creates an account for you, you can choose whether to provide HeyTap with information, such as your username (or display name), profile picture, and sex, to complete your account details. For details, refer to the HeyTap Account Privacy Notice to understand how HeyTap uses and processes your personal information.After you sign in to your account to use the App on your phone, the auto sign-in feature will be turned on so that your user experience will not be interrupted.

(2) Profile setting

In the App, you can tap "Me" and the account icon sequentially to set your profile. We will collect your profile picture, sex, display name, date of birth, height, and weight so that we can effectively calculate your health data based on the collected information. When relevant smart devices are connected to the App, the sex, date of birth, height, and weight you have entered or will enter in the App or your call logs on your phone may be synced to the relevant smart wearable devices for more accurate data monitoring and App usage statistics.

(3) Device pairing, device management, and device information widgets

You can pair smart devices (such as smart home devices, which include safety protection devices, lighting fixtures, energy-saving devices, and appliances, or wearable devices, which include bands, watches, and body fat scales) with the App for easy device management. To this end, we need to collect the names and MAC addresses of such devices so that we can establish a Bluetooth connection between such devices and your phone to successfully pair them to the App, thus allowing you to manage their settings, display the source of their data, control and manage them, and check their working status and usage data. Such information will also enable us to not only collect the usage statistics of such devices and related services but also improve their quality.

You can go to the "My Devices" feature page to view information about the smart devices paired with the App, including their connection status.

(4) Device sharing

When you share a smart device in your home with other family members, you need to provide their phone numbers or email addresses to us so that they can receive information about the smart device.

(5) Location services

The Home feature allows you to connect and control your smart home devices and to configure personalized scenes, including tap-to-run and auto scenes. When you set the location of your home or create an auto scene via the Home feature, if you specify the location as a trigger condition to automate the relevant smart devices in your home to perform the specified action, we need to obtain your location information. When you specify leaving or arriving at a specific place as a condition to trigger an auto scene, we use the location information we collected to realize the geofencing function, which allows us to determine the distance between the specified place and your current location and figure out whether you have left or entered the specified place. For example, you can configure your air conditioner to automatically turn on/off when you enter/leave your home. When you specify "When outdoor weather changes" as a condition to trigger an auto scene, we use your location information to determine the weather near the place you specified. For example, you may configure a room light to automatically turn on at sunset. When you tap "Turn on ranking" in the Workout section, the App will collect your location information so that it will be able to show you the workout rankings of all the realme Link users located in the same city as you.

We may also collect your location information to generate a workout route and provide weather services for you. In addition, when you attempt to pair a smart device with the App, some third-party systems/apps on your phone, such as the Android system, may request permission to turn on Location to discover the smart device.

If you do not provide the above information, you will not be able to connect your smart devices to realme Link, or you may be restricted in using some of its features. We will ask you whether to turn on Location for location-based apps. You can go to the Settings app on your phone to change the location settings, such as by changing or disabling the methods and servers used for location-based services to change the location information to be provided to us.

(7) Workout and health monitoring

In order for the App to record and manage your workout and health data and show you the working status of your wearable sports/health device, detected data, and historical statistics, we need to collect your step count, sleep data, heart rate, Spo2 data, workout logs, stress data, standing time, workout route, workout type, sleep report, workout duration, heart rate during exercise, menstrual cycle (if you are a female), body fat percentage, weight, body energy monitoring data, and VO2 max, in addition to your device's location and the duration and volume of ambient noise. The workout route and location information are sensitive personal information. The purpose of collecting such information is to record and calculate your daily workout data and routes so as to provide you with personalized fitness services. If you do not provide such information, we will not be able to show you the working status of your wearable sports/health device, real-time workout and health data, and historical workout and health statistics.

(8) Workout ranking

When you tap "Turn on ranking" in the Workout section, we will collect your location information, profile picture, display name, workout distances, steps, and active calories so that the App can show you the workout rankings of all the realme Link users located in the same city as you.

(9) realme Store

To let you make purchases on realme Link, the App has integrated the realme Store SDK. When you use the realme Store feature, the SDK will process relevant information about you.

Both the App and the realme Store feature are operated by realme. They share the same infrastructure, system, and technology and provide a relevant, consistent, and secure experience in the realme products you use. For example, you can use the same account to sign in to the App and realme Store. Subject to applicable laws and in compliance with the terms and policies designed for the App, we may process information related to you. For details on how realme Store processes personal information, please refer to the realme Store Privacy Notice.

(10) Help & feedback

When you use the Help & feedback feature of the App, we will collect your contact information and the description and category of your issue or suggestion so that we can verify your identity and handle your feedback. You can also choose whether to send your error logs to us to help us diagnose your issue more accurately. The Android system is designed in such a way that your error or crash events will include the overall system status at the time of the event. We use such information only for error log analysis, and we will not use it for individual identification or any other purposes. The logs we collect are cleared on a regular basis.

(11) Reminders and notifications

In the App, you can set reminders and notifications for a paired smart device, such as incoming call and message notifications, Clock alarms, event reminders, and health reminders. Such features do not collect your personal information. You can set and manage them in the App on your own. If the smart device you are using can show caller IDs and answer calls, when it is connected to the App, you can configure in the App some of your phone contacts as your frequent contacts. The App may collect such contacts and transmit them to the smart device through Bluetooth so that the smart device can display a notification when you receive a call or message from any one of them. Such information will only be retained locally on your device and it will not be uploaded to our cloud server. You can process such information at your own discretion.

(12) Push notification

To provide you with push notifications, we will collect and use your IMEI/MAC/Android ID/IDFA/OpenUDID/GUID, SIM card's IMSI information, and location information, notifying you of app service messages in a timely manner.

(13) Body fat scale pairing

When you use your body fat scale connected to the App, we will collect the measured data, including your body fat percentage, weight, BMI, muscle mass, fat mass, obesity grade, visceral fat index, lean body mass, body water percentage, bone mass, protein percentage, basal metabolic rate, and biological age, so that we can display such data to you.

(14) Voice service

If a paired smart device is a security camera that supports voice communication, when you use its voice communication function via the App, we need to collect your voice data for you to control and use the smart device. Such information will only be processed locally and will not be uploaded to our cloud server.

(15) Ask AI

When you use our products or services, you can access the Ask AI feature. On the Ask AI screen, you can tap the voice button in the lower-left corner, and then hold down the Hold to talk button, talk, and release it to send a voice message. Alternatively, you can directly enter a message in the text box. The Ask AI feature will search online for relevant information and then provide you with the answer. You can repeat this process to ask more questions. Services relating to this feature are provided by third-party service providers. To find out how the third-party service providers process the voice and text messages you enter and the personal information contained therein, refer to the "Personal Information We Share with Third Parties" appended at the end of this Privacy Notice. During your use of the Ask AI feature, we will not collect your voice messages, text messages, or personal information contained therein, nor will we upload such information to our servers.

When you use the Ask AI feature, you can choose whether to use an exercise/diet plan exclusively designed for you. If you choose to do so, the height, weight, date of birth, and sex you entered in the App as well as the workout types in your workout logs and your location will be transmitted to the corresponding third-party service provider so that it can generate an exclusive workout/diet plan for you. If you do not provide such information, we will not be able to generate an exclusive workout/diet plan for you.

(16) AI watch faces

When you use our products or services, you can access the AI watch faces feature. Then, you can enter a message in the text box and tap "Generate". We will then generate an image as you instructed, and you can set it as your watch face. Services relating to this feature are provided by third-party service providers. To find out how the third-party service providers process the text messages you enter and the personal information contained therein, refer to the "Personal Information We Share with Third Parties" appended at the end of this Privacy Notice. During your use of the AI watch faces feature, we will not collect the text messages you enter, nor will we upload them to our servers.

(17) User experience optimization

When you use a paired smart device, we need to obtain your Android ID and behavioral data, such as product feature usage data, product upgrade data, website browsing data, tap events, and performance data.We collect such information to optimize our product features and the logic of our user interface layout and to develop new product features so as to make our user interface layout and features more usable.

(18) Third-party device pairing

During your use of our products or services, you can tap "Pair device" to add certain products produced by our ecosystem service partners (or third-party manufacturers), such as watches, bands, body fat scales, and other similar products. When you use the relevant features, the corresponding third-party manufacturers may also collect your personal information. Before using these features, you should carefully read the user agreement or privacy notice of the third-party manufacturers. We are not responsible for how the third-party manufacturers use the personal information they collect from you, nor can we control their use of such information.

The information described above will be encrypted during transmission and uploaded to our server for storage unless it is explicitly stated that information is only kept locally. The App will access data from the server based on your authorization and display the data on the device control screen. For data kept locally, we will not be able to provide you with any support or service in terms of personal information processing, but you can process such data at your own discretion.

Please be aware and understand that the features and services that we provide to you are constantly updated and developed. Depending on the characteristics of the App and the paired smart devices, we may also request and collect your personal information in other scenarios. If this is the case, we will inform you through the terms and conditions separately developed for the related products or devices, screen prompts, or interactive processes to obtain your consent.

1.1.2 Required app permissions

When you use the App, we may request certain permissions from your phone, such as Bluetooth, Access the network, Contacts, Call logs, Phone (Read phone state, Make phone calls, and Answer phone calls), SMS, Camera, Microphone, Storage, Photos (iOS), Location, Body sensors, Physical activity (Access motion and fitness data), and Monitor notifications so that we can collect your relevant personal information and provide you the related features or services.

If some important or sensitive permissions are required by our services or features, we will request your consent to turn them on through a pop-up prompt when you attempt to use these services or features. For the permissions that are toggled on and can be turned off, you can go to "Me - Settings - Manage permissions" in the App at any time to turn them off, which acts as your revocation of consent. (The operation paths for managing app permissions may vary by device model and OS version.) After you withdraw your consent, we will cease to use the relevant permissions and will no longer be able to provide you with the related features or services, but this will not affect your use of other unrelated features or services.

 

Please note that we may work with third-party service providers to provide the features or services described above. Such providers may receive and store some of your personal information, but they will not use such information for any other purposes.

 

1.2 How we use your personal information

We may use your personal information for the following purposes:

  • To provide, process, maintain, improve, and develop our products and/or services, as well as the services provided through the connected devices or realme Link.
  • To communicate with you, provide customer support to you, or notify you through push services. We will communicate with you about your devices, services, or any general inquiries (concerning updates, device firmware/software upgrades, customer queries and support, relevant information, and notifications) by methods such as notifications and customer service follow-ups.
  • To improve products and the user experience. We will perform statistical analysis of collected information on the use of our products and services to improve and develop our products and services, improve the user experience of our products, and enhance their performance. You can go to the Settings section of the App to exit our User Experience Program. After you exit the Program, we will delete or anonymize all Program-related data that we collect from your device.
  • To provide you with personalized services, send you push notifications, and recommend and display the content and ads tailored for you through our services.
  • To provide you with generative AI services.
  • To provide direct marketing services. We may use your contact information (such as your phone number and email address), account ID, and IMEI to provide you with promotional information about our products and services or those of our affiliates or partners (in relation to networking, mobile apps, and cloud products and services). We strictly comply with the requirements of data protection laws in your jurisdiction. We will use your data only after obtaining explicit prior consent from you or through a clear affirmative action to confirm that you have expressed no objection. If you no longer wish to receive certain types of emails, you can send us an SMS message or email to unsubscribe or otherwise contact us to unsubscribe.
  • To conduct analyses and audits and prevent fraud. We may use the data you provide to verify your identity, analyze our business efficiency, review user transactions, and prevent fraud. We only use statistical data for these purposes, and the use of such data will not be associated with you.
  • To permit and manage your participation in our lucky draws, competitions, or other similar marketing and promotional activities.
  • To keep and maintain records of information relating to you. We may use such information in our operations or to fulfill our legal obligations.
  • To fulfill other purposes as authorized by you.

Where our use of your information goes beyond the purposes set forth in this Privacy Notice or the purposes notified at the time of collection but has a direct or reasonable connection with those purposes, we will ask for your consent in advance. Without your consent, we will not provide your personal information or behavioral data to any third party, except as otherwise specified by laws and regulations.

 

1.3 Exceptions to informed consent concerning information collection and use

You are fully aware that under applicable laws, we may collect and use your personal information without your authorization or consent in the following circumstances:

(1) as necessary to enter into a contract at your request or to perform the contract to which you are a party;

(2) as necessary for us to comply with a legal obligation or duty;

(3) as necessary to respond to public health emergencies or to protect the life, health, and property of natural persons in emergencies;

(4) the processing of personal information is within a reasonable scope and intended for news reports, public opinion supervision, and other similar tasks carried out in the public interest;

(5) the personal information that we process has been made public by you or otherwise legally disclosed and is within a reasonable scope;

(6) other circumstances as specified by laws and regulations.

 

2. How We Retain and Transmit Your Personal Information

2.1 How we retain your personal information

We will retain your personal information for the minimum period needed to provide you with our products and/or services unless laws otherwise specify or unless you separately authorize us to retain the personal information for a longer period. After you take the initiative to request the deletion of your personal information in connection with the App or when the minimum retention period expires, we will delete or anonymize your personal information as soon as possible in accordance with laws and regulations, unless otherwise specified by laws and regulations. If laws specify a longer retention period, we will delete or anonymize the related personal information upon the expiration of this extended period.

We determine the minimum retention period mainly based on the following: (1) The purposes for which the personal information is processed: whether the purposes have been fulfilled or are unable to be fulfilled, or whether the processing becomes unnecessary due to business changes or discontinuance; (2) The amount, category, and sensitivity of the personal information; (3) The potential risks arising from unauthorized use or disclosure of your personal information; (4) The necessity to maintain relevant transaction and activity records to address your information query requests or complaints you might raise in the future; (5) The safeguards available to ensure the security and quality of the services we provide to you; (6) The data retention period otherwise specified by laws or administrative regulations.

If you have seriously violated laws, regulations, or our relevant product/service agreements, policies, or rules during your use of the App, the records of your violations as well as your credit records and personal information in relation to the App will be retained for the maximum period permitted by law.

If we discontinue the operations of some or all of our products or services for any special reason, we will inform you in advance and cease to collect and process your personal information in connection with the App. We will also delete or anonymize the personal information that we hold in connection with the discontinued products or services unless otherwise specified by laws and regulations.

2.2 How we transmit your personal information

As a company headquartered in China and operating globally, we provide products and services through our resources and servers distributed around the world. We have built data centers in countries such as China, France, Singapore, and India. This means that pursuant to local applicable laws and regulations, your personal information may be transferred to or accessed from a jurisdiction outside the country or region where you use the relevant products or services. In principle, personal information collected and generated in the People's Republic of China will be stored within the People's Republic of China, and the personal information collected and generated in the EU will be stored within the EU.

You understand that there are different risks under different data protection laws. We will take measures to ensure that the data collected by us is processed in accordance with this Privacy Notice and applicable laws and that your personal information is as equally protected as in the country or region where you use the relevant product or service. For example, we will obtain your consent to the cross-border transfer of your personal information or take security measures, such as encryption, de-identification, or entering into a necessary data transfer/sharing agreement with the recipient of your data, before transferring such data across borders.

 

3. How We Entrust, Share, Transfer, and Disclose Your Personal Information

3.1 How we entrust third parties to process personal information

To provide you with better services, we will entrust third parties to process your personal information on our behalf, such as companies that send SMS messages or emails or that provide technical support on our behalf. Such companies are entrusted to use your personal information only to provide you with the required services.

We will require each entrusted party (a company, organization, or individual) to observe strict confidentiality obligations and take effective confidentiality measures through a written agreement, on-site audits, or any other means as required by law. We will require the party to process your personal information only within the scope of entrustment and not to use your personal information for their own benefit. In the written agreement, we will strictly define the purpose for which the processing is carried out, the time limit, the processing method, the categories of personal information, protection measures, and the rights and obligations of us and the entrusted party. We will supervise their processing of personal information.

3.2 How we share personal information

realme may, from time to time, share certain personal information with our affiliates and strategic partners to provide the products or services you request. We will not share your personal information with any third party for their own marketing or business purposes. In a personal information sharing scenario, both parties have independent control over the shared personal information. We will share your personal information only for legitimate, proper, necessary, specific, and explicit purposes. We will only share the personal information necessary to provide the required services. Where explicitly required by laws and regulations, we will separately obtain your consent prior to the sharing. The third parties concerned will have no right to use your personal information shared by us for any other purpose. We will sign a data protection agreement or regulation with each third party, requiring them to take confidentiality and security measures during their processing of the shared personal information and clarifying their responsibility and obligation to protect your personal information.

When our affiliates and/or partners request your personal information necessary to provide you with services in the App, if you deny their request, you may not be able to enjoy some of the services that they provide in the App.

We will not share your personal information with any third party unless this Privacy Notice specifies otherwise or except for the circumstances described below:

(1) Sharing with our affiliates.

To provide you with a greater variety of better products and services, we may legally share the necessary personal information with our affiliates from time to time through APIs or offline channels. We will only share the necessary personal information and comply with the purposes stated in this Privacy Notice. If we or our affiliates intend to change the purpose for which your personal information is used and processed, we will obtain your authorization or consent again.

(2) Sharing with third-party service providers to realize the required product or service features.

Some of our product or service features are provided by third-party service providers. To provide you with the features or services you request, we may need to share the necessary personal information about you with such third parties. To learn more about what personal information we will share with our third-party partners, refer to "Personal Information We Share with Third Parties" appended at the end of this Privacy Notice.

(3) Sharing with third-party software development kit (SDK) providers.

Our products and services may contain SDK plugins provided by our authorized partners. When you use relevant services provided by our authorized partners in the App, the plugins concerned will collect and process your personal information. To protect the security of your information to the maximum extent possible, we strongly recommend that you read the privacy terms of any third-party SDKs before using the services provided by such SDKs. If you find any risks relating to such SDKs or other similar apps, you are advised to immediately stop using them and promptly contact us in order to safeguard your legitimate rights and interests.

To find out what personal information will be shared with third-party service providers through the App or what third-party SDKs are used in the App, refer to "Personal Information We Share with Third Parties" appended at the end of this Privacy Notice.

(4) Sharing in other circumstances

Should we be legally required to comply with laws and regulations, legal procedures, litigation, and/or mandatory requirements of public institutions and government authorities, we may share your personal information to the minimum necessary extent.

We may also disclose your personal information if we sincerely believe that disclosure is necessary to protect you or to detect, prevent, and deal with fraud, unauthorized use of our products, violation of our terms or policies, or other harmful or illegal activities. To the extent and only as expressly permitted by local data protection laws, we will collect, use, or disclose your personal information without your consent. This may include providing information to public institutions or government agencies and communicating with our partners about the reliability of your account to prevent fraud, violations, and other harmful acts committed in or out of our products or services.

3.3 How we transfer personal information

We do not transfer your personal information to any company, organization, or individual, except in the following cases:

(1) The transfer is made at your request and in compliance with the requirements of relevant government authorities;

(2) We are required to provide your personal information by applicable laws, regulations, legal procedures, and mandatory administrative or judicial requirements;

4. How We Protect Your Personal Information

4.1 Our data security measures

We take personal privacy very seriously. We take all reasonable and actionable technical and organizational measures to protect the personal information we collect in connection with our services from unauthorized access, disclosure, use, or alteration, or from damage or loss. We will take the initiative to delete your personal information or you may ask us to do so in any of the following circumstances:

(D) You have the right to opt out of the sale of your personal information to a third party. Please note that we do not sell any personal information, including that of teenagers under the age of 16.

We will match the identifying information you provide with the personal information we hold. If we are unable to verify your identity from the information we hold, we may ask you to provide additional information. You can also delegate an authorized agent registered with the Secretary of State of California to raise a request on your behalf. In the event of a request raised by your authorized agent, we may ask the agent to provide proof of authorization to act on your behalf. If the agent is unable to provide the proof, we may reject the request.

 

We will respond to all verified requests within 45 days as provided by the CCPA. Where necessary, we will extend the time limit by 45 more days with an explanation.
